Registration in Ukraine remains one of the key conditions for using state services, banking products, and participating in official procedures. However, a question arises — is it possible to register a place of residence in a house without the owner's permission? Legislation provides a clear answer.

Current legal norms stipulate that one can only register in their own housing or with the consent of its owner or co-owners, as 'Facts ICTV' reports. Any other means that imply registration without permission will be illegal.

How to obtain registration with the owner's consent

If a person does not own real estate but has received consent from the house owner, the registration procedure is quite simple. There are two main ways — online and offline.

Online via the 'Diia' portal

  • The individual submits an application for residence registration.
  • The property owner receives an electronic request for confirmation of consent.
  • After confirmation, the information is automatically transmitted to the registration authority.

Offline at the CNAP

  1. Submission of documents in paper form.
  2. The owner's consent is confirmed personally or notarized.
  3. Mandatory submission of ownership documents for the housing.

Lawyer Roman Simutin emphasizes that even the fact of long-term registration does not confer any property rights:

'Neither a year nor ten years of living in someone else's apartment will make you its owner,' says the expert.

Why it is impossible to register without the owner's consent

During the registration of a place of residence, documents from both the registering person and the property owner are necessarily submitted. This includes a passport, identification code, and a document confirming ownership. Without this data, no CNAP or electronic service will process the registration.

Furthermore, since December 1, 2021, owners have been granted additional control tools. According to the law on declaration and registration of place of residence, they can independently initiate the removal of a person from registration in an extrajudicial manner.

Are there exceptions to the rule

There are only a few situations when the owner's consent is not required:

  • If it concerns the registration of minor children along with their parents;
  • If the housing is in communal or state ownership and the individual has officially received it;
  • If registration occurs in a service or dormitory premises by decision of the administration.

However, even in these cases, there are restrictions and document requirements.

What risks are there for those registering without consent

Attempting to register without the owner's consent may be regarded as document forgery or fraud. Such actions may lead not only to the cancellation of registration but also to administrative or criminal liability.

'Register only through legal means, as otherwise you may face not only refusal but also problems with the law,' emphasizes Simutin.

As reported, owning a house goes beyond physical control; it is an officially registered right that provides you with full legal protection. Without proper documentation, significant problems may arise during the sale, donation, inheritance, or legalization of real estate.

It is also often mistakenly believed that registration of residence in Ukraine automatically grants the right to a share of the property after the owner's death. In reality, registration is not a basis for inheritance and does not confer any property rights to the individual regarding the housing.

Ukrainian legislation clearly establishes that registration can only occur in one's own housing or with the owner's consent. Registration without permission is considered illegal and may have serious consequences for the person violating this rule. Adhering to the law during the registration process is crucial to avoiding legal issues in the future.
