In everyday life, Ukrainians often believe that registration means ownership of property. However, this is just a formal procedure that does not confer any ownership rights to the property.

Registration is the address where a registered person is located. The property does not necessarily have to be owned by the person who is registered there. This is confirmed by attorney Alla Neroda, explaining that this is solely for administrative purposes.

How to register a place of residence

In order to register a residence, a person must provide a passport, documents for the property, a receipt for payment of the fee, and written consent from the property owner, if they are not the person being registered.

'If the property belongs to several owners, consent from each of them must be obtained', the lawyer adds.

Does registration grant property rights?

Many people believe that registration means ownership rights to the property. However, this is a misunderstanding. Registration does not grant any rights to property or inheritance.

'Registration only indicates the person's place of residence, but does not confirm ownership', emphasizes Neroda.

Consequences of having registered persons in a property for the owner

Registering other persons in one's own property can have negative consequences for the owner. The lawyer warns about the following risks:

  1. Eviction through the court. If a person does not agree to voluntarily deregister, the owner has to force them to leave through a court decision.
  2. Problems with guardianship. Deregistering a child from an apartment without the permission of the guardianship authorities can become a difficult task.
  3. Complications when selling. Having registered individuals in the apartment complicates legal procedures when formalizing sales agreements.
  4. Bureaucratic difficulties. All official notices and court documents are sent to the registration address, which can create problems for the owner.

Rights associated with registration

Even without ownership rights, registration has its significance. It allows the use of housing, receiving social benefits, choosing a doctor, participating in elections, and going to court.
