Refusing to pay fines for such violations can also lead to a search order. Crucially, even with an active search warrant, a person retains the right to apply for a legal deferral from mobilization.
Challenging a TRC's Actions
This process can be complex, as resolving search warrant issues does not always require a physical visit to the TRC. Legal experts advise first contesting an unlawful search warrant through an out-of-court procedure by initiating written correspondence with the TRC.
"I recommend you challenge an unlawful TRC search warrant first through an out-of-court procedure (via written correspondence with the TRC), and then through the courts," states lawyer Vladyslav Derii.
Should the TRC refuse to resolve the issue of canceling the search warrant, the citizen has the right to file a lawsuit with an administrative court. This legal action can compel the TRC to remove the data concerning military registration violations from the official Register.
