Court Halts Railway Worker's Mobilization, Citing Draft Center's Legal Breach.
Ruling by the Volyn District Administrative Court
According to Novyny.live: The Volyn District Administrative Court has ruled that the mobilization of an employee of JSC 'Ukrzaliznytsia' was unlawful, as the worker held a valid exemption from conscription. The court determined the actions of the Territorial Recruitment Center (TRC) to be illegitimate.
The plaintiff, employed as a rolling stock repair mechanic, had been granted a conscription deferral on February 12, 2025, which was valid until February 2026. Despite this, TRC personnel took him to a mobilization point in June 2025. At the time of the summons, the 'Oberih' Unified State Register of Conscripts contained no information about his deferral, a key fact that formed the basis for the legal challenge against the TRC's actions.
Implications of the Court's Decision
The court annulled the mobilization order, as well as the order enrolling the man into a military unit's personnel roster. This ruling can be appealed.
This case underscores the critical importance of adhering to deferral and conscription regulations in Ukraine, particularly during the ongoing conflict. The court's decision may set a precedent for other individuals with valid exemptions and highlights potential systemic issues in mobilization procedures that require refinement to prevent future errors. Such legal disputes are not uncommon as Ukraine balances military needs with the legal protections afforded to essential workers in critical industries.
