Court canceled conscription of a man with deferment: details of the decision.
A court session took place in Rivne concerning the fact that summoned a man to the military, although he had a deferment and was on the reservation list. However, the court decided to side with the conscript.
This is stated in the court ruling, which was published in the .
Details of the Case
According to the case materials, the man, who was summoned to the Armed Forces of Ukraine in April 2025, filed a lawsuit. He claimed that at the time of conscription he had a deferment and an active reservation from conscription, as he worked as a conductor at the 'Passenger Car Depot of Chernivtsi'. Considering this, he believed that the conscription was unjustified and demanded its cancellation through the court.
The case materials also indicated that the defendants - the territorial staffing center and the military unit - had no objections to the lawsuit and did not provide their position in writing.
Court Decision
The case was handled by Judge Svitlana Dulyanytska of the Rivne District Administrative Court. After reviewing the documents and evidence, she established that the plaintiff had an active deferment from conscription - from December 2024 to August 2025. Therefore, at the time of conscription, he should not have been summoned.
The court concluded that the actions of the military enlistment office were unlawful. The judge fully satisfied the claim: she recognized the conscription order as illegal, canceled the decision to enlist the man in the military lists, and demanded his removal from these lists. However, the court's decision has not yet entered into legal force and may be appealed.
Lastly, it is worth mentioning that recently in Kyiv, a man paid a fine imposed by the Center. After that, he won in court, and the court decided to return his money.
