Military Lawyer Clarifies: Mobilization Officials and Police Cannot Confiscate Phones.
Citizen Rights at Military Recruitment Centers
According to Novyny.live: Military lawyer Diana Ternova has stated that personnel at Territorial Recruitment and Social Support Centers (TRSCs) are not authorized to confiscate mobile phones from citizens present at these facilities. She further clarified that police officers also lack the legal power to seize such devices. This guidance comes amid ongoing national mobilization efforts and clarifies the legal boundaries for officials interacting with civilians.
Diana Ternova explained that simply being at a recruitment center does not justify restricting a person's communication. She stressed the critical importance of upholding citizens' rights, stating:
'Neither police officers nor TRSC staff have the right to confiscate a phone or prohibit its use. This constitutes a direct violation of the right to defense and access to a lawyer, which is guaranteed by the Constitution.' Diana Ternova
Context of the Statement
Ternova's clarification gains relevance following recent comments by Pavlo Palisa, Deputy Head of the President's Office, on mobilization. Palisa noted that the pace of mobilization has improved over the last seven months, which has prompted legitimate public questions regarding the protection of individual rights during these procedures.
The military lawyer's statement underscores the necessity of adhering to human rights standards throughout mobilization processes, especially as state activity in this area intensifies. Clear legal norms governing the conduct of law enforcement and military structures are fundamental to ensuring the rule of law and protecting the rights of citizens in Ukraine.
