A conscript in Ternopil region received 3 years for refusing mobilization: case details.
A conscript in Ternopil region refused to serve in the rear after the Military Medical Commission (MMC). The court found him guilty of evading mobilization.
This is stated in the Unified State Register of Court Decisions.
Case details
During the court session, it was clarified that the conscript was recognized as fit for mobilization by the Military Medical Commission (MMC). Despite this, the man refused to receive the summons.
During the court hearing, the defendant partially admitted his guilt. He explained that after being notified about receiving the summons, he called the police, and then approached the head of the village police. The latter called representatives of the Territorial Recruitment Center (TRC), who brought the man to the MMC. After passing the MMC, he was sent to Ternopil to confirm his fitness for mobilization.
Subsequently, he was offered to serve in the Armed Forces of Ukraine (AFU) as a clerk, but the man refused this offer.
Later, realizing the possibility of criminal liability, he tried to enlist in the TRC and military units of Ternopil region, but to no avail. The defendant expressed remorse for his actions, explaining them by his health condition and the need to care for his sick mother. He asked the court to take these circumstances into account when determining the punishment.
Court ruling
After reviewing the case materials, the court found the man guilty of committing a criminal offense under Article 336 of the Criminal Code of Ukraine and sentenced him to imprisonment for a term of 3 years.
It is worth noting that in Khmelnytskyi region, a man broke the nose of a TRC and SP employee. For this, he will spend three years in prison.
We also reported that a resident of Dnipro was sentenced to 15 years in prison for treason. He voluntarily fought on the side of the occupiers.
