Draft Summons Without a Warrant

According to Novyny.live: Lawyer Polina Marchenko has revealed a new practice where individuals eligible for military service can be taken directly to recruitment centers (TCCs) even if they are not officially listed as wanted, including following road traffic accidents. She noted that this raises serious questions about the legality of such actions under current legislation. This development occurs within the broader context of Ukraine's ongoing efforts to bolster its armed forces.

Marchenko explained that a person liable for military service can be declared wanted even during a period of deferment. This means individuals already registered as eligible for service could face mobilization, regardless of any active search warrant.

"These actions do not always appear to comply with the requirements of current legislation, but in practice, they are aimed at ensuring the person is brought to the recruitment center," emphasized lawyer Polina Marchenko.

Mobilization Issues and Risks

Marchenko further stated that if a person involved in an accident does not require immediate medical attention—meaning an ambulance does not take them to the hospital from the scene—in most cases, either the at-fault driver or the victim can be escorted to a TCC after the accident report is filed. This approach has already caused concern among Ukrainians, many of whom have begun receiving fine notifications in the 'Reserve+' app. The situation requires further public discussion and official clarification to prevent misunderstandings regarding mobilization procedures.

This information underscores the complex legal landscape surrounding mobilization in Ukraine, particularly in the context of road accidents. Given the current situation, it is crucial for citizens to be aware of their rights, obligations, and the potential risks associated with the draft. Clearer guidance from state authorities could help alleviate public anxiety and ensure legal clarity for all involved.
