Military Obligations in Ukraine Under Scrutiny
According to Novyny.live: In Ukraine, individuals liable for military service can be placed on a wanted list for violating military registration rules. This measure is part of broader efforts to enforce civic duties during wartime. The only way to avoid detention for such violations is to voluntarily enlist for mobilization, which prevents being forcibly taken to a Territorial Recruitment Center (TRC).
The 'Wanted' status can be removed either through a self-initiated process or automatically if the case is closed one year after the relevant ruling is issued. Importantly, administrative liability can only be enforced within one year from the date of the offense. After this period expires, the TRC must issue a decision to close the case, allowing the individual to be removed from the wanted list. According to Ruslan Ruzhytsky,
“a person submits a statement through the app acknowledging the violation. The TRC then issues a ruling and removes them from the wanted list.”
Detention Time Limits and the Importance of Legal Compliance
The duration of detention for those liable for military service is regulated by law, with only police officers authorized to carry out arrests. After an administrative report is filed, the offender must be released within three hours. If a fine needs to be paid, this can be done through the 'Reserve+' app. Notably, a TRC official in Zaporizhzhia was recently convicted for corruption, underscoring the critical need for adherence to the law in this area.
Ruslan Ruzhytsky emphasizes that each TRC must be dealt with on a case-by-case basis, as every situation may require a tailored approach. Ultimately, those liable for military service have options to resolve their issues and avoid negative consequences for violating registration rules.
The situation in Ukraine highlights the heightened need to monitor compliance with military duties under martial law. Voluntary mobilization programs and the possibility of canceling a 'Wanted' status provide pathways to resolve conflicts for those who have broken the rules. At the same time, cases of corruption reinforce the importance of legal compliance and increase accountability among TRC officials.
