Property owners can officially refuse ownership: what does it mean.
There are situations when a property owner cannot maintain their property or simply does not wish to do so. In this case, Ukrainian legislation provides for a procedure for voluntary renunciation of ownership rights, which involves a complete cessation of the right to possess the item or object.
To refuse ownership rights, one must officially declare this or take actions that confirm such refusal. The procedure requires proper documentation and the issuance of the corresponding entry in the state register.
What does voluntary renunciation of ownership rights mean
The legislation directly states that an owner has the right to renounce ownership by submitting a written application. However, this procedure is complex and requires proper documentation, and unwillingness to use the property does not mean an automatic renunciation of it.
Voluntary renunciation of ownership rights to real estate
If an owner wishes to renounce real estate, they must submit a written application and a document confirming their ownership rights. For minor owners, permission from a guardianship authority is required. The registration procedure costs 300 UAH and takes up to five days.
Voluntary renunciation of ownership rights to land
A landowner may only renounce the land in favor of the state or a territorial community. The procedure involves consideration of the application by the authority, signing an agreement, and notarization. Renunciation of land is free of charge and subject to certain conditions.
What risks are associated with voluntary renunciation of ownership
Renunciation of ownership means complete loss of rights to the property and impossibility of its return. There are risks that should be considered, such as the inability to withdraw the application or the transfer of encumbered property. The procedure is also complex for land plots, where the consent of the authorities is required.
Voluntary renunciation of ownership rights allows property owners to relinquish their ownership rights to property under certain conditions and with risks of losing the property without the possibility of its return.
