Why Disability Deferrals Can Be Denied Due to Student Status in Ukraine.
General Mobilization in Ukraine
According to Novyny.live: Ukraine remains under a state of general mobilization, declared following the imposition of martial law. While citizens with disabilities are entitled to a military service deferral, complications can arise. For individuals who already hold an active educational deferral, a new application for a disability-based deferral may be rejected. This legal nuance is critical for those navigating the conscription process during the ongoing conflict.
Extension of Deferrals and Legal Advice
Attorney Yuriy Aivazian has clarified that educational deferrals are automatically extended. This can create a situation where a person with a disability, intending to secure a medical deferral, finds their application blocked because an active student deferral is already on record. To successfully apply for a disability deferral, the existing educational deferral must first be formally cancelled.
Consequently, it is vital to ensure any current student deferral is revoked before submitting a request for a disability-based postponement. As Yuriy Aivazian emphasized:
“You must first cancel the educational deferral, and only then submit a request through 'Reserve+' to obtain a disability deferral.” - Yuriy Aivazian
This procedural detail requires careful attention, as proper documentation directly impacts the likelihood of securing a lawful deferral.
Under martial law, the rules governing mobilization and exemptions are of paramount importance. Citizens with disabilities who qualify for deferrals must stay informed about procedures and requirements, which are subject to change. This highlights the necessity of legal support and consultation for individuals who may encounter obstacles while processing their deferral applications.
