Who Can Get a Draft Deferment for Caregiving? Eligibility Explained.
Deferment from Mobilization for Conscription-Eligible Individuals
According to Novyny.live: Conscription-eligible citizens may qualify for a deferment from military mobilization if they are caring for a close relative with a disability. This deferment is granted based on specific legal grounds outlined in Ukrainian law. A person subject to military service can apply for a deferment to care for a father or mother who has a disability. It is important to note that mobilization applies only to those who are conscription-eligible, while individuals of pre-conscription age cannot be mobilized.
The deferment is only available to conscription-eligible individuals who meet the criteria defined by legislation. For instance, if a mother has a second-group disability, her adult children are legally obligated to care for their incapacitated parents, as stipulated in Part 2 of Article 51 of the Constitution of Ukraine. This provision highlights the social responsibility of children toward parents who require assistance and support.
Social Significance of the Deferment
Additionally, citizens who have secured a deferment for caregiving are permitted to travel abroad with the relative they are caring for. However, as legal expert Yuriy Ayvazyan explains,
“it is impossible to literally renounce the care of a mother in a legal sense, because the duty of adult children to care for their incapacitated parents is directly provided for in Part 2 of Article 51 of the Constitution of Ukraine.”He further notes that
“it is more accurate to speak not of refusing care, but of the lack of actual ability to personally provide constant daily care due to being abroad.”
In this way, the system of mobilization deferments for conscription-eligible individuals caring for relatives with disabilities holds significant social value. It helps maintain family bonds and ensures that necessary help reaches those who need attention.
This legal provision is crucial for offering social support to those responsible for caring for people with disabilities, and it helps prevent conflicts between military duties and family obligations. Given the current challenges related to mobilization, this initiative can be an important step in preserving social stability and well-being in society.
