The conclusion of the LCC is ending - will the TCC refuse the deferral?.
If a conscript citizen receives a deferral from mobilization based on the conclusion of the LCC, the TCC must accept this conclusion, even if its validity expires soon. Otherwise, a new conclusion will not be issued to the citizen.
This was reported on the portal 'Yuristi.UA' lawyer Yuri Aivazyan.
The validity period of the LCC conclusion is ending
Some conscripted citizens receive a deferral from mobilization based on the LCC data.
One of the questions posed by a citizen was whether he could be refused a deferral because the LCC conclusion is only valid until September 2025, and a new one will not be issued, citing that the existing one is still valid.
Lawyer Yuri Aivazyan explained that in such a situation, the TCC cannot refuse the deferral.
The TCC has no right to refuse
Aivazyan explained why the TCC must accept and take into account the LCC conclusion that is about to expire.
'The LCC conclusion was issued for a year, and a new one will not be provided to you before the expiration of this term,'
- the lawyer explained.
Thus, the TCC must use the existing conclusion of the LCC, regardless of when it ceases to be valid.
The explanation of lawyer Yuri Aivazyan demonstrates that the validity period of the LCC conclusion is an important element when obtaining a deferral from mobilization, and the TCC must adhere to this rule, regardless of the conclusion's validity period.Read also
