Diplomatic Institutions: Obligations and Limitations

Vladislav Yurchak noted that, while Ukraine's diplomatic representations have certain obligations related to the military registration of citizens, they cannot deliver summons. Recently, the government approved a new procedure for military registration of conscripts, servicemen, and reservists, which includes new functions for consulates and embassies.

Innovations in the Activities of Diplomatic Institutions

  • informing Ukrainian conscripts about new recruitments and mobilization measures;
  • transmitting data to military authorities about individuals who have registered or deregistered from consular registration;
  • assisting the return of mobilized citizens to Ukraine during mobilization.

However, as Yurchak emphasized, no diplomatic institution has the right to deliver summons to citizens who are abroad. Their activities are focused solely on consular registration and communication with citizens, and the delivery of summons remains possible only on the territory of Ukraine.

“Even after the update of the military registration procedure, diplomatic institutions have not received the authority for direct delivery of summons. Their function is only accounting and informational,” the expert explained.

According to the lawyer, the government is gradually improving the system of military registration, but for Ukrainians who temporarily or permanently reside abroad, the conditions of mobilization legislation remain unchanged. Diplomats can provide information to the relevant authorities in Ukraine, but do not perform the functions of territorial recruitment centers.

It was previously reported that Ukrainian servicemen who left abroad with a deferment might face serious consequences if they do not return on time.

This situation highlights the importance of Ukrainians understanding that, despite being abroad, their military responsibility remains relevant. Relations with diplomatic institutions are more of an accounting and informational nature than practical actions, so it is necessary to closely monitor changes in legislation concerning mobilization and military registration.
