Court Reduces Sentence for Reserved Man Who Evaded Military Service.
Man with Deferral Evades Military Call-Up
According to Novyny.live: A resident of the Poltava region avoided conscription during mobilization, despite holding a valid reservation from service. The man was registered for military duty and had passed his military medical commission. On June 18, 2022, he was served a mobilization order requiring him to report to a training center by June 25, 2022.
Court's Ruling
The Chutove District Court of Poltava Oblast initially sentenced the defendant to three years in prison for evading military service. However, the court decided to replace this prison term with a one-year probationary sentence. During the hearing, the defendant expressed his state of mind, stating:
'I was afraid'
This statement reflects the emotional state of the individual within the context of the ongoing mobilization. Ukraine has maintained a general mobilization since the full-scale invasion began, with strict penalties for evasion. This case highlights the tension between legal obligations and personal fear during wartime.
The proceedings underscore the critical importance of fulfilling mobilization duties in a time of war, while also acknowledging the impact of psychological state on the decisions of those facing conscription. The substitution of imprisonment for probation may indicate the court considered the defendant's personal circumstances, yet it raises questions about the effect such rulings have on overall military discipline and the national mobilization effort.
