Living in a summer house all year round - can Ukrainians be penalized?.
A summer house for many Ukrainians is not just a place to relax on weekends, but a dream of their own cozy home away from the city hustle. The number of people considering turning their summer cottage into a full-fledged place for year-round living is increasing. However, it's important to consider all the nuances before making such an important decision.

Summer house and permanent residence under the law
Until 2022, it was impossible to officially register a place of residence in a garden or summer house in Ukraine. This created problems for many Ukrainians who moved out of the cities and sought to live closer to nature.
However, after amendments to the legislation, it is now allowed to register a place of residence in a summer or garden house if it meets certain criteria. In other words, it has become formally possible to live there year-round, provided that the dwelling is suitable for permanent living.
How to convert a summer house into residential status
To live in a summer house not just in the summer, its functional designation needs to be changed.
'This means: to convert the object from a garden or summer house to residential housing,' emphasize specialists from the law firm 'Legal Aid.'
For this:
- The house must be capital, with a foundation;
- Have engineering communications (electricity, water, heating);
- Comply with construction regulations;
- Be registered in the Register of Real Estate.
Documents for changing functional designation can be submitted through the administrative services center or through the state portal 'DiiA.'
What documents are needed to change the status of the house
The official procedure includes:
- Title documents for the land plot;
- Technical passport of the house;
- Report on technical inspection (if the house is old);
- Application to convert the object into residential fund.
The decision is made by the executive body of local self-government. By law, the time frame for considering the application should not exceed 30 days.
Registration in a summer house in 2025
If the house has already been entered into the register as a residential one, then it is possible to register a place of residence there - in simpler terms, to get registered.
This became possible due to the updated edition of the Law 'On Freedom of Movement and Free Choice of Place of Residence in Ukraine', which directly allows registration in garden and summer houses. At the same time, it is not necessary to submit a utility contract - the fact of residence and the owner's consent are sufficient.
Requirements for a summer house for permanent residence
You can live in a garden house all year round if:
- It has heating and thermal insulation;
- Access to electricity, water supply, sewage;
- The structure withstands temperature fluctuations;
- There is an address (assigned by the local self-government body).
If these conditions are not met, the house may be declared unsuitable for habitation, thus the registration will be denied.
At the same time, living in a summer house in winter without changing its status is possible, but officially it will be considered temporary residence.
'Without changing the designation of the house and registering it, this does not give the right to medical care at the place of residence, receiving subsidies, or participating in local elections. In addition, there may be difficulties accessing certain administrative services', emphasizes lawyer Yana Chernyshova.
