Discharging Service Members with Disabilities

According to Novyny.live: Soldiers in the Armed Forces of Ukraine who have become disabled are now entitled to leave military service. The discharge process can be handled remotely, even if the individual is currently hospitalized. This is a crucial measure that safeguards the rights of personnel who can no longer fulfill their duties due to health conditions.

For example, one service member who was assigned a third disability group after spinal surgery faced a refusal to be discharged. The issue stemmed from inaction by his commanding officer. Lawyer Vladyslav Deriy explains that the discharge procedure must follow the law. He emphasizes that troops can submit their resignation request via 'Ukrposhta' (Ukraine’s postal service), making the process much easier for those unable to return to their unit.

Age Limits and Required Documents for Discharge

During a period of martial law, Ukraine imposes specific age thresholds for leaving the military:

  • 60 years for enlisted personnel, sergeants, senior non-commissioned officers, and junior officers;
  • 65 years for senior officers.

Deriy also warns against neglecting the situation. He adds that the resignation request must include notarized copies of the MSEC (Medical-Social Expert Commission) certificate confirming the disability group, hospital discharge summaries (epicrisis), and the combatant status ID.

Service members who cannot physically return to their base due to their health can instead address their resignation request to the head of the local territorial recruitment and social support center. This alternative route ensures their rights are upheld and that they can access the necessary assistance. Ukrainian laws, particularly the Law 'On Military Duty and Military Service,' govern these procedures, making them as transparent and straightforward as possible for everyone involved.

Allowing disabled soldiers to resign is a vital element of social support for those who sustained injuries while serving during wartime. Given the current situation in the country, proper adherence to the legal rules regarding their discharge can have a significant impact on their future lives and reintegration into society.
