Chinese Father Sued by 10-Year-Old Son for Spending His Savings.
Legal Action by a 10-Year-Old in China
According to TSN.ua: A 10-year-old boy from Zhengzhou city in China's Henan province has taken his father to court. The lawsuit alleges the father spent the child's savings without his consent. After divorcing the boy's mother, the father withdrew over 80,000 yuan (approximately 506,000 Ukrainian hryvnias) from an account in his son's name. This money consisted of traditional Chinese New Year gifts and other savings the boy had accumulated.
The court found that the father used the entire sum to cover expenses for his own wedding. In its ruling, the court determined that gifted money constitutes a child's personal property. Consequently, it ordered the father to repay 82,750 yuan (about 526,245 hryvnias), plus accrued interest.
Debate on Children's Rights and Parental Responsibility
This case has sparked a public debate in China concerning children's rights and the financial responsibilities of parents when managing their offspring's assets. It highlights the critical need to protect minors in financial matters and questions the extent of parental authority over money that legally belongs to the child. Such cases are relatively rare but reflect growing legal awareness.
The court's decision could set a legal precedent for similar disputes in the future, potentially influencing legislative initiatives aimed at strengthening the protection of minors' rights in other regions.
