Retroactive Child Support Claims

According to Novyny.live: Parents or guardians can seek child support for past periods if they can demonstrate they previously attempted to obtain it. A court has the authority to award such retroactive support, but for a maximum of ten years. This legal provision allows for the recovery of unpaid support, provided evidence of earlier efforts to collect is presented.

Support Arrears and Financial Assistance

Child support arrears accumulate when payments mandated by a court order or notarial agreement are missed. It is important to note that in Ukraine, children are entitled to receive support until age 23 if they continue their education, ensuring financial assistance during their studies. This system is designed to provide stability for young adults pursuing higher learning.

  • Starting January 1, 2026, the minimum monthly child support amounts will be:
    • 1,408.5 hryvnias for children under six years old;
    • 1,756 hryvnias for children aged six to 18.
  • Furthermore, the financial assistance payment for the birth of a child will increase to 50,000 hryvnias from January 1, 2026.

These upcoming legislative changes aim to improve the financial security of children. The ability to claim a decade of back support, coupled with the raised minimum payments, will enhance the well-being of families. As Roman Simutin noted:

“In such a case, the court may award alimony for the past period, but for no more than ten years.”
It is crucial for parents to be fully aware of their rights and legal options in these matters.

The reforms to child support and birth assistance laws are expected to have a significant positive impact on the country's socio-economic landscape. By increasing support levels, the state is fostering better conditions for raising children and supporting families. This underscores the importance of legal awareness, which can help reduce instances of non-payment and improve financial stability for households in need.
