Fines from TCC for mobilized individuals: Do they need to pay for accounting violations.
According to inkorr.com: In Ukraine, there has been a legal confusion regarding administrative fines imposed by Territorial Recruitment Centers (TCC) on military conscripts who were later mobilized. Lawyers on the 'Yuristy.UA' portal explain whether these fines should be paid in such cases. This was reported by Novyny.Live.
Many people believe that after mobilization, all fines should be canceled, but lawyers provide conflicting comments. Human rights defenders have not reached a consensus on the necessity of paying these penalties.
Position 1: The fine must be paid
Lawyer Yuri Aivazyan noted that mobilization is not grounds for automatically canceling the debt. He emphasized:
'Mobilization of a man has no relation to his violation of military accounting rules in the status of 'military conscript'.
Thus, if a man does not pay 8,500 hryvnias, he will later have to pay 17,000 hryvnias. He also added that, in case of non-payment, TCC will forward the case to the enforcement service.
Position 2: The fine should have been canceled
Another lawyer, Vladislav Deryi, believes that the situation with such fines is different, and mobilized men should not be punished.
'A man should not be fined, and the case should have been closed, since servicemen with military accounting violations are fully exempt from paying fines from TCC', the lawyer emphasized.
This position is based on the general principle of exempting servicemen from administrative liability for accounting violations committed before mobilization.
Action algorithm for mobilized individuals
Given the ambiguity of the legal practice, Vladislav Deryi advises not to pay the fine and actively defend your rights.
Here are recommended actions to challenge the TCC fine after mobilization:
- Submit a request to TCC demanding official cancellation of the fine based on obtaining conscript status.
- Challenge the TCC ruling in court, using the fact of military service as the main argument.
Since servicemen are exempt from paying such penalties, this may become an effective measure to protect against forced collection. It has previously been discussed how to find out if there is a fine from TCC.
It is also worth noting that from July 17, 2025, territorial recruitment centers will not be able to impose fines for late updates of military accounting data. This applies to violations that occurred before July 16, 2024, when Ukrainians were to update their data through 'Reserve+' or in person at TCC.
Thus, questions regarding the payment of administrative fines after mobilization remain open and require clear legal regulation. As can be seen, lawyers' positions significantly differ, putting military conscripts in a difficult position. It is recommended to carefully study your rights and, if necessary, seek assistance from specialists.
