European Court lifted sanctions on Bohuslaiev: details of the decision against the EU Council.
The European Court recognized the illegality of the continued inclusion of the name of the former president of 'Motor Sich' in the EU sanctions lists. This was reported by Bohuslaiev's lawyer Stepan Teslia, referring to the court ruling.
Resonant decision of the European Union Court
According to inkorr.com: The European Union made an important decision – to repeal a number of acts of the EU Council, due to which Vyacheslav Bohuslaiev remained on the list of persons subject to restrictions due to actions that threaten the sovereignty and territorial integrity of Ukraine.
Information about the acts:
- Council Decision (EU) 2024/2456 and Implementing Regulation (EU) 2024/2455 of September 12, 2024;Council Decision (EU) 2025/528 and Implementing Regulation (EU) 2025/527 of March 14, 2025.
Legal consequences of the verdict
The Court emphasized that the retention of Vyacheslav Bohuslaiev's name on the sanctions lists has no legal basis. Consequently, the aforementioned acts of the EU Council lose their validity.
Compensation of costs
Currently, the provisions of the latest ruling – Council Decision (EU) 2025/528 – remain in force for Bohuslaiev until the deadline for filing an appeal or until the final rejection of such an appeal, if it is filed.
The Court also ordered the Council of the European Union to cover its own legal costs and to compensate the expenses of Vyacheslav Bohuslaiev.
Thus, the lifting of sanctions against the former president of 'Motor Sich' has become a positive step for him and his company. It has also raised questions about the effectiveness of EU sanctions measures, as the case demonstrates how important it is to adhere to legal norms in their application.
