Ukrainians will lose their land shares: who will manage to formalize it by 2028.
According to ТСН: Land share owners in Ukraine must formalize their rights to their plots by January 1, 2028. Otherwise, the land will pass into communal ownership. Plots that are not formalized may be recognized as ownerless if they remain in collective ownership or are not formalized by heirs.
Lawyer Anastasia Blinda emphasizes that Ukraine's Law No. 899-IV establishes clear rules for the registration of land plots (shares) that formerly belonged to collective agricultural enterprises, cooperatives, and joint-stock companies.
Additional time for formalization
If the owner of an unclaimed share or their heir missed the deadline for registering ownership for a valid reason, the court may grant additional time to complete this procedure.
Allocation of shares
If there are no lands in collective ownership, a share may be allocated from the land reserve of the community, if available.
Period after transition to communal ownership
Once the land from the unclaimed share transfers to communal ownership, it cannot be transferred to private ownership for 7 years, except in cases where it is returned to the owner or heirs.
This initiative aims to regulate the issue of land ownership that has remained without an owner. Importantly, legal norms are focused on protecting the interests of communities and encouraging the registration of land plots. Thus, owners have enough time to take necessary actions to avoid losing their rights to the land.
