According to TSN.ua: In Ukraine, the process for extending a mobilization deferral is not automatic and carries significant risks for those eligible for military service, primarily due to documentation errors. While the government intended to simplify the process by allowing Administrative Service Centers (ASCs or TsNAPs) to accept applications, the specific operational procedures of these centers can complicate obtaining an extension. This system places a heavy burden of proof and precision on the applicant.
Lawyer Polina Marchenko emphasized that an incomplete application package can lead to a denial of an extension. This poses a serious issue, as even minor mistakes in paperwork can have severe consequences.
"The ASC administrator either accepts documents strictly according to the list specified in the government decree, or only those documents the applicant has brought," Marchenko explains.
Common Errors and Their Consequences
Typical mistakes that result in rejection include:
- an incomplete set of documents from the applicant;
- procedural errors made by the administrator.
In such cases, Marchenko adds, individuals receive a phone call informing them that 'documents have been received regarding your deferral, you need to come to the Territorial Recruitment Center (TRC).' This underscores the critical importance of meticulous document preparation and submission.
Furthermore, administrative liability for violating military registration rules entails a fine ranging from 17,000 to 25,500 hryvnias under Part 3 of Article 210 of the Code of Ukraine on Administrative Offenses. Therefore, those liable for military service must be exceptionally careful when filing documents to avoid negative outcomes and potential fines. The legal landscape surrounding mobilization is complex and constantly evolving, making procedural compliance essential.
Given the difficulties associated with securing a mobilization deferral, it is vital for eligible individuals to be fully aware of all documentation requirements and processing procedures. Incorrectly filed paperwork can significantly worsen one's situation, making it advisable to seek consultations from lawyers or ASC specialists.
