Land market: how to privatize a plot for combatants.
Participants in combat operations have priority rights to receive land plots, but martial law may affect this right. According to legislation, during martial law, free privatization of land without buildings and structures is prohibited.
However, if there is a legal building on the plot, such as a residential house, garage, or cottage, or the plot was transferred for use before January 1, 2002, privatization can be carried out even during martial law.
Five types of land plots that combat participants have priority rights to include:
- plots for residential construction (0.1 - 0.25 hectares);
- plots for garage construction (up to 0.01 hectares);
- plots for building a cottage (up to 0.1 hectares);
- plots for gardening and horticulture (up to 0.12 hectares);
- plots for agriculture (up to 2.0 hectares).
However, each type of designation can be privatized for free only once. For example, it is impossible to privatize 0.06 hectares for residential construction and then another 0.04 hectares under another residential building. But it is possible to privatize 0.1 hectares under a residential house and 0.01 hectares under a garage.
After the martial law ends, it is even possible to privatize a plot that has no buildings. The privatization procedure includes submitting an application to the State Geocadastre body or the local council (if the land is communal), agreeing to the processing of personal data, as well as a document confirming participation in combat operations.
To search for a free land plot, you can use the cadastral map, visit the locality in person, visit the website of the Main Department of State Geocadastre, or contact the local council.
The executive authority or local self-government that transfers the land plot into ownership makes a decision to approve the land management project and grant ownership. After that, it is necessary to contact the relevant authority to obtain an extract from the register of property rights and encumbrances, presenting the necessary documents.
