During the dissolution of marriage, the question of dividing jointly owned property acquired during cohabitation arises. According to Article 57 of the Family Code of Ukraine, all property acquired during marriage is considered joint.
Regardless of the source of income, all property acquired by spouses during marriage belongs to both as joint ownership. This category includes all assets except personal belongings.
What Property is Not Divided in Case of Divorce
Property acquired before the marriage, received as an inheritance or gift during the marriage, is not subject to division. Personal property also includes insurance payments and compensations.
- Personal belongings refer to items for individual use and jewelry, even if purchased with joint funds.
- Awards and prizes received for personal achievements remain the sole property of the recipient.
- Property acquired by one spouse after the actual divorce may be recognized as their personal property.
- If personal funds of one spouse were used to purchase property, the corresponding share in that property is recognized as individual ownership.
How Long Can Property be Divided
Claims for property division can be made without time limitations if the marriage is not dissolved. In the case of divorce, the statute of limitations is three years.
Dissolution of marriage incurs financial expenses. There is also the possibility of transferring property to another person on a gratuitous basis through a gift agreement.
The division of property during divorce is a relevant issue for couples who are separating. According to Ukrainian legislation, all joint property is involved in the division, but there are some exceptions regulated by law.
