The woman’s son, who had a Group II disability, disappeared in 2020. Following three years of investigation and uncertainty, a court officially declared him deceased in 2024. As a result, the mother received a portion of the overdue pension amounting to over 56,000 hryvnias. However, the remaining debt stood at 37,400 hryvnias.
The initial trial court ordered the Pension Fund to pay the outstanding balance owed to the son. This ruling was later upheld on appeal, marking a key milestone in the legal process. The court also mandated that the Pension Fund disburse the full pension amount the son had not received, either as a payment to relatives within the first six months after death or, if that deadline was missed, as part of the inheritance. This case highlights the critical need to safeguard heirs’ rights in such circumstances.
