According to Novyny.live: In a January 28 interview on 'Den.LIVE,' legal expert Yaroslav Kuts clarified that having three or more children does not automatically protect a father from military mobilization if he has outstanding child support debts exceeding three months. This situation, he stated, results in the loss of the right to a deferral. This interpretation highlights the Ukrainian government's effort to balance family protections with civic responsibilities during wartime.
Kuts further explained that a stepfather who is the legal guardian of three children retains the right to a deferral. He noted that the mobilization law has remained unchanged since 2024, and court precedents already confirm the deferral rights of non-biological parents. However, to secure a deferral, an individual must provide proof of financially supporting the children.
'The mere fact of having three children no longer guarantees protection,' emphasized Yaroslav Kuts, detailing why a father with three or more dependents might be denied a mobilization deferral due to unpaid alimony.
