According to inkorr.com: A man in Zaporizhzhia has been sentenced to three years in prison for refusing mobilization. The sentence was issued by the Shevchenkivskyi District Court after the man, having received a summons, categorically refused to accept it. This was reported by 'Hromadske' citing tsn.ua.

As stated in the ruling of the Shevchenkivskyi District Court, a resident of Zaporizhzhia passed the military medical commission, which recognized him as fit for mobilization. In March 2024, attempts were made to hand him a summons, but the defendant refused to receive it and evaded mobilization.

At the court hearing, the accused did not admit his guilt and stated that 'he did not evade mobilization'. He explained his refusal to accept the summons by alleging that 'the Territorial Center for Recruitment and Social Support violated his rights regarding the accounting and issuance of his military document'.

Punishment for evasion of mobilization

The court reviewed all the materials of the case and concluded that the accused intentionally evaded appearing at the Territorial Center for Recruitment and Social Support for more than a year and a half after refusing to accept the summons. During the consideration of the criminal case, the man did not attempt to rectify the situation and voluntarily join the ranks of the Armed Forces, which confirms his conscious actions aimed at avoiding conscription.

A resident of Zaporizhzhia is found guilty under Article 336 of the Criminal Code of Ukraine, leading to a three-year imprisonment.

This sentence is subject to appeal in the appellate court.

Thus, the man was sentenced to three years in prison for refusing mobilization, despite being recognized as fit for military service. He claimed his rights regarding accounting and issuance of military documents were violated. The court, having reviewed the case, found him guilty and applied relevant legal norms.
