Ukrainians in Poland were told how to receive sick leave payments.
Ukrainians were explained how to obtain sick leave and temporary disability payments in Poland.
This was reported by "Spilno in Poland".
As a result of Russian aggression, many Ukrainians have gone abroad, particularly to Poland. For such Ukrainians who work or plan to work, it is important to know about their rights and procedures related to sick leave and temporary disability payments.
Every worker who is insured against sickness, including Ukrainians, has this right.
This applies to individuals who work on the terms of:- an employment contract;- a contract of mandate and pay insurance contributions;- self-employed persons who regularly pay contributions to ZUS.
It should be noted that temporary disability assistance can be obtained after a certain period of continuous insurance.
30 DAYS - for employees under an employment contract.
90 DAYS - for self-employed persons and persons working under a contract of mandate and registered for voluntary sickness insurance.
The amount of sick leave payments is determined based on the average monthly salary for the last 12 months before the sick leave.
Additionally, it should be noted that the calculation is made from the gross salary, but without the payment of social insurance contributions.
If an employee receives 5000 zlotys gross, the amounts of sick leave are calculated as follows:
- 80% of the salary (for standard sick leave) amounts to 4000 zlotys gross;- 100% of the salary (for sick leave in connection with pregnancy or a work-related accident) amounts to 5000 zlotys gross;- 70% of the salary (in case of hospitalization) amounts to 3500 zlotys gross.
If additional information about sick leave payments is needed, it is recommended to call 224440205.
Sick leave may be paid by the employer or ZUS, depending on the duration of the sick leave.
- If the sick leave lasts up to 33 days per year, the employer makes the payment.- If the sick leave lasts more than 33 days, the responsibility for payment transfers to ZUS.
This is especially important for those who need long-term treatment, such as after surgeries or in case of chronic diseases.
To receive temporary disability assistance:- You must submit an application and provide a certificate of incapacity for work (L4 from the Social Insurance Authority).- If an electronic certificate of incapacity (e-ZLA) is received, the process is automatically transferred to the Social Insurance Authority (ZUS).- If the sick leave lasts more than 33 days, the employee must contact ZUS for the continuation of the payment assistance.
Employees on sick leave have the right to protection of their workplace. The employer cannot terminate the employment contract during the sick leave.
But if the sick leave lasts more than 182 days, the employer can terminate the employment contract if the employee has not returned to work after the end of the sick leave.
We remind you that Ukrainian students in Poland can receive a certain scholarship.
