Military Personnel Sentenced for Evading Service

According to Novyny.live: A Ukrainian serviceman has been sentenced to five years in prison for refusing to obey an order to deploy to Sloviansk. The Kolomyia City District Court in the Ivano-Frankivsk region issued the verdict on January 19. This case highlights the strict legal consequences for military disobedience during Ukraine's ongoing war for national survival.

The individual in question was mobilized on November 19, 2024, and subsequently assigned as a reserve soldier to the 29th Reserve Company. Upon refusing to travel to the combat zone, he stated that he did not consider himself a soldier. The court ruled his actions were in violation of military service duties and imposed the five-year sentence. The verdict can be appealed within 30 days, with any appeal to be heard by the Ivano-Frankivsk Court of Appeal.

Conscripted service under martial law cannot be replaced with an alternative.

The presiding judge noted that this ruling sets a significant precedent regarding the fulfillment of military duties during the conflict in Ukraine. Other recent cases in the region include:

  • A resident of the Lviv region, who disclosed the location of air-raid warning groups, received a three-year suspended sentence;
  • A resident of Mykolaiv, who aided Russian forces, was sentenced to 15 years in prison with property confiscation.

This sentence underscores the severe approach Ukrainian courts are taking toward cases of military service evasion, which is treated as a critical matter of national security. Such rulings can impact military morale and public perception of the duty to defend the country, especially as the war continues. It is important to note that judicial practice in this area is still evolving, and similar cases may establish a foundation for future legal assessments.
