According to ТСН: The use of generators in enclosed spaces or apartments is a serious violation of fire safety rules and can threaten life. Recently, a fire occurred in the Cherkasy region due to a generator running inside a building. Earlier, an explosion of a generator led to the ignition of a large private house of a popular blogger, resulting in the death of her relative.
During operation, a gasoline or diesel generator heats up significantly, which may cause furniture or synthetic materials to ignite. Even a small fuel leak or a spark can lead to an explosion. Carbon monoxide (CO) is odorless, and just ten minutes of generator operation in an enclosed space can create dangerous gas concentrations. Toxic fumes quickly spread through ventilation ducts, threatening the lives of people in nearby apartments.
What could be the consequences
Turning on a generator in an apartment entails administrative liability — a fine of up to 3400 hryvnias. If a fire, explosion, or poisoning occurs as a result of the owner's actions, criminal penalties are possible:
Article 270 of the Criminal Code — violation of fire safety requirements (up to 3 years of imprisonment, up to 8 years if there are fatalities).
Article 119 of the Criminal Code — manslaughter (if death occurs from carbon monoxide).
Article 194 of the Criminal Code — intentional destruction or damage to property (if the neighboring apartments were affected).
Civil liability includes compensation to neighbors for repairs, restoration of housing, destroyed items or treatment after poisoning. Claims can reach hundreds of thousands of hryvnias.
If someone in the building turns on the generator, residents must call the police and notify the HOA or management company. Inspectors will document the violation, and the building manager can draft an act and formally demand the violator cease their actions. In case of non-compliance, a statement under Article 270 of the Criminal Code may be submitted to the district police department.
What are safe alternatives
In light of frequent power outages, it is safer to use inverter charging stations: they do not emit carbon monoxide, do not overheat, and provide lighting, internet, and operation of household appliances.
The State Emergency Service also reminds of the key rules for safe operation: install the generator only outdoors, at least six meters away from windows and doors, protect it from precipitation, do not refuel while operating or shortly after stopping, take breaks of at least 30 minutes after every 5 hours of operation, and limit access for children and pets.
It is important to remember that the safe use of generators can prevent tragedies. Everyone must take responsibility for their safety and the safety of others by following operating rules. All these measures will help preserve life and property and avoid legal consequences.
