Derzhpratsia revealed the list of employees who cannot be dismissed.
According to inkorr.com: In Ukraine, according to the explanations of Derzhpratsia,
an employee can be dismissed at the initiative of the employernot always. The law clearly defines categories of persons who have special guarantees for the preservation of their jobs. This is reported by the Judicial and Legal Newspaper.
According to part three of Article 184 of the Labor Code of Ukraine, there are categories of employees whose dismissal is prohibited. The only exception is the complete liquidation of the enterprise, which allows dismissal, but under the obligatory condition of employment.
Who is guaranteed additional protection against dismissal
After the expiration of the
fixed-term employment contractthese employees are also not left without support. They are guaranteed mandatory employment, and the average salary is retained for up to three months from the date of dismissal.
The law defines groups of employees who are protected from dismissal at the initiative of the employer:
pregnant women;
women with children up to three (or up to six) years;
single mothers with children up to 14 years or with disabilities;
women dismissed after a fixed-term contract, with the right to mandatory employment.
What employers need to know
Derzhpratsia emphasizesthat in the event of the liquidation of the enterprise, the employer is obliged to assist in the further employment of protected employees. Failure to comply with this requirement may be considered a violation of labor legislation.
Lawyers emphasize: even in the context of a difficult economic situation or layoffs, the employer must adhere to social guarantees and has no right to dismiss employees who are under protection without following the established procedure.
Thus, the legislation of Ukraine provides additional protection for vulnerable categories of employees and places the responsibility on employers to adhere to social guarantees. This is especially important in the context of the modern economy, where the protection of employees' rights becomes a key issue for ensuring fair working conditions.
