Salaries are not retained for the mobilized: who will receive compensations.
According to inkorr.com: Lawyers clarified to Ukrainians whether salaries for mobilized employees are retained. According to 'Khvylia', this information was provided by specialists from the law firm 'Bachynskyi and Partners'.
Martial law and general mobilization continue in Ukraine, during which men of draft age receive summons and are sent to service.
Legal consultants noted that Article 119 of the Labor Code of Ukraine guarantees mobilized Ukrainians the right to return to their previous position. However, the situation with financial support is different: according to legislative act No. 2352 dated July 1, 2022 'On Amendments to Some Laws of Ukraine regarding the Optimization of Labor Relations', employers are exempted from the obligation to pay salaries to mobilized employees.
Conditions for compensation for the mobilized
Lawyers pointed out that the law 'On Amendments to Some Legislative Acts of Ukraine concerning the Regulation of the Provision and Use of Leaves, as well as Other Issues' defines categories of persons entitled to compensation payments:
- those called up for mobilization;
- contractors;
- conscripts;
- reservists;
- officers serving.
Experts emphasized that compensation payments include accumulated unused leave, as well as childcare benefits.
It is important to note that compensation is not automatically credited — the serviceman must submit a request to the organization's leadership. This should be done no later than the last day of the month when he joined the Armed Forces of Ukraine.
Thus, it is important for Ukrainians to know their rights and possibilities during mobilization. After being called to military service, they may not receive a salary, but there are chances for compensation payments if the relevant documents are submitted on time. This provides a certain level of financial support for the mobilized and their families during difficult times.
