Kyiv businessman sentenced to three years for evading mobilization: details of the case.
In the Zakarpattia region, a Kyiv businessman was tried for evading mobilization. The man, who is one of the co-owners of a capital company, will have to spend several years in prison.
Details of the case
According to court documents, the defendant has been on military registration since July 15, 2022, and holds the rank of reserve officer. The man underwent a medical commission and received a summons to report to a military unit, but did not do so.
Court's decision
During the court session, the accused did not admit his guilt. The man stated that after the start of the full-scale invasion of the Russian Federation into Ukraine, he left Irpin for a recreation base in the village of Novoselytsia in the Tyachiv district to settle his relatives there before returning to the capital to pay his employees' salaries. The owner of the recreation base warned the entrepreneur that to stay there, he needed to register with the military, so he went to the Military Recruitment Center and signed all the documents presented to him. The next day, he did not appear for the summons because he went to Obukhiv, whose mayor offered him to join a volunteer battalion.
According to the defendant, he sent the Tyachiv district police a contract to participate in the volunteer formation, but after that, he was notified of suspicion. He also added that he has grounds for deferral, but did not use this right.
The judge established that the accused joined the volunteer battalion on March 18, 2022, while he was supposed to arrive according to the summons on March 15. The lawyer did not provide evidence of direct participation in combat actions or other actions that indicate the fulfillment of military duty.
The businessman was found guilty and sentenced to three years of imprisonment. Within 30 days from the date of the verdict, the court's decision can be appealed by filing an appeal.
During the trial, it was established that the businessman evaded mobilization, explaining this by his participation in the volunteer battalion. However, the court found him guilty of this crime and sentenced him to three years in prison. Despite the explanations and arguments of the defendant, the court's decision remained unfavorable for him.
