According to TSN.ua: The Ivano-Frankivsk Court of Appeals has mandated that the state compensate a man with 5 million hryvnias for moral damages, following his wrongful conviction for murder based on insufficient evidence. This decision concludes a lengthy legal battle that began after a crime occurred on the night of August 18-19, 2013, in the Kolomyia district. For an English-speaking audience, it highlights ongoing concerns about judicial fairness and wrongful imprisonment in Ukraine.

According to case materials, the defendant, a 28-year-old man with a prior criminal record for theft, was accused of stabbing an elderly woman 26 times. He was initially sentenced to 13 years in prison, of which he served 6.5 years. Released on his own recognizance in 2020, he was again convicted and sentenced to 13 years in 2024.

Case Dismissal and Compensation

In January 2025, the Supreme Court overturned all previous rulings and closed the case. Subsequently, the man filed a lawsuit seeking 15 million hryvnias in moral damages. The Kolomyia City District Court partially granted his claim, awarding 2 million hryvnias. However, the appeals court reviewed the case and increased the compensation to 5 million hryvnias.

This case underscores the critical importance of upholding human rights within the judicial process and may set a significant precedent for future legal practice in Ukraine.
