Five-Year Prison Sentence for Deserter in Ivano-Frankivsk: Why Leniency Was Denied.
Man Convicted for Desertion Under Martial Law
According to TSN.ua: In Ivano-Frankivsk, a man has been sentenced for voluntarily abandoning his military unit during a period of martial law. Mobilized in February 2024, the defendant fled from his units on two separate occasions, leading to a verdict handed down by the Ivano-Frankivsk City Court on March 17, 2026. The court imposed a punishment of five years' imprisonment under Part 5 of Article 407 of the Criminal Code of Ukraine, along with a fine of 34,000 hryvnias.
Escape History and Court Response
The individual's pattern of escape began in late February 2025, when he first left his military unit. A second desertion occurred on June 6, 2025. The accused justified his actions by expressing dissatisfaction with the treatment he received from his commanders:
“I did not like how the commanders treated me.”
However, the presiding judge emphasized that during martial law, while others risk their lives on the front lines, excusing the unauthorized abandonment of a unit would demoralize the army and erode discipline. The judge stated:
“This is unacceptable.”
Notably, the man has an extensive criminal record, including prior convictions for robbery and assault. This history also factored into the court's decision. The case has sparked public outrage, as desertion is viewed extremely negatively during wartime. The sentence aims to underscore the necessity of maintaining military discipline and accountability under martial law.
This incident highlights the seriousness of breaches in military discipline during conflict and the need for punishment for desertion, which undermines army morale. Authorities are working to strengthen military discipline, considering the detrimental effects of such actions on national security and defense capabilities. This verdict may serve as a deterrent for others contemplating unauthorized leave from military service under martial law.
