Early Cancellation of Deferment for Ukrainians: A Lawyer Outlines the Conditions.
Mobilization in Ukraine
According to TSN.ua: Ukraine is currently undergoing a mobilization effort that calls up eligible men for military service. While some individuals qualify for a deferment, which exempts them from conscription, military lawyer Mykhailo Lobunko explains that this protection can be revoked early under specific circumstances outlined in Clause 31 of Procedure No. 76.
Grounds for Revoking Deferment
Several factors can lead to the loss of this special status, including:
- the company losing its designation as a critical enterprise;
- the employee being dismissed from their position;
- an employer’s request to end the deferment;
- the closure or liquidation of the company;
- failure to meet the deferment conditions.
Lobunko notes that
“the deferment remains automatically in effect”, but employers are required to inform the territorial recruitment center (TRC) within three days if an employee’s role or department changes.
Starting April 1, 2023, Ukraine’s mobilization process will undergo changes. These reforms include the introduction of automatic data exchange between the 'Oberih' registry, the Tax Service, and the Pension Fund. Additionally, the procedure for extending employee deferments has been simplified through the 'Diia' electronic service. The government has also expanded the list of critical enterprises, allowing more workers to qualify for deferment.
These updates aim to streamline the deferment process for employees at vital enterprises while ensuring effective mobilization during wartime.
The adjustments to Ukraine’s mobilization system reflect the state’s adaptation to the ongoing conflict and the need to sustain critical infrastructure. Automating procedures and easing access to deferments could reduce the administrative burden on employers and help retain key personnel in sectors essential to the country’s functioning. This, in turn, may support economic stability and social balance during the mobilization period.
