Who else, besides the Territorial Center for Recruitment, can serve summons: new notification rules.
According to ТСН: In Ukraine, mobilization is underway, and recently, the Territorial Centers for Recruitment and Social Support announced who can serve summons to military conscripts, besides their representatives.
List of persons entitled to serve summons
Here is who can serve summons:
Representatives of the Territorial Centers for Recruitment and Social Support
Representatives of structural subdivisions of district and city state administrations (military administrations)
Representatives of executive bodies of village, settlement, city, district councils in cities (if established)
Representatives of enterprises, institutions, and organizations
Representatives of the relevant branch of intelligence agencies, the Central Office, or regional offices of the Security Service of Ukraine (only for reservists and military conscripts registered with these agencies).
Lawyers specializing in mobilization issues explain that representatives of local councils, including utility companies, also have the right to serve summons.
They are empowered specifically to serve summons. That is, to carry out notifications, says lawyer Kateryna Anishchenko.
Algorithm for serving summons
In her opinion, the process of serving summons occurs according to the following algorithm:
A directive comes from the Territorial Center for Recruitment, where the latter asks to notify/ensure attendance. Accordingly, authorized persons are obliged to respond to this. For instance, the head of the utility company is obliged to serve the summons. If the person refuses to receive it or is not found at their place of residence, an act is drawn up regarding this.
Representatives of administrations and settlement councils are also authorized to notify.
The process might look like this: a phone call during which the military conscript is informed that they should appear to receive the summons. As far as I know from practice, heads of homeowners associations can visit the residence of the military conscript, adds Anishchenko.
Duties of authorized persons
Employees of institutions entitled to serve summons are obliged to report to the Territorial Center for Recruitment on the results of their work.
If the summons is served and the person does not appear, then such a man faces a fine, specifies the lawyer.
Lawyer Andrii Mezhyrytskyi believes that involving officials who do not relate to the Territorial Center for Recruitment is not sufficiently effective.
The Territorial Center for Recruitment can indeed delegate powers to other officials to notify specific persons. That is, those who are either subordinate to them or live in the territory that is within the responsibility of specific officials, he notes.
He also emphasizes that the notification mechanism remains undefined in many cases.
Locations for serving summons
According to the Territorial Center for Recruitment, serving summons to reservists and military conscripts continues around the clock.
Serving can occur:
At the address of the place of residence or at the declared/registered place of residence
At the place of work, study
In public places, public buildings, and structures
In places of mass gatherings of people
At territorial centers for recruitment and social support
At border crossing points (checkpoints), points of entry through the state border of Ukraine.
Thus, mobilization in Ukraine is undergoing an active stage, and the efforts of many participants in the process become extremely important for ensuring the replenishment of military ranks. Serving summons significantly depends on the work of numerous organizations and structures involved in this process. The transparency and clarity of actions of all authorized persons remain important, which, in turn, will affect the effectiveness of mobilization measures.
