Real Estate Sales in Ukraine: What Documents a Notary Must Check.
Preparing documents for the sale of an apartment or house is very important. The transaction may not take place due to the absence of even one important document. The owner must have a complete set of documents that confirm their right to the property.
One of the first steps is the verification of the seller's identity by the notary. For this, a passport and identification code are required. If the property is owned by several people, each of them must present their documents. If one of the co-owners cannot be present, a notarized power of attorney can be used.
Documents on Marital Status
When selling property acquired during marriage, the consent of both spouses is required. The notary may also request a marriage certificate or its dissolution. If only one spouse is indicated in the register, the transaction will not be concluded without the consent of the other.
Title Documents for Real Estate
Real estate sales are not possible without documents that confirm ownership. This can be a contract, a certificate of ownership, an extract from the register of property rights, etc. Errors in such documents may cause the notary to refuse to certify the transaction.
Technical Passport for Housing
All real estate objects must have a technical passport, which specifies the characteristics of the housing. This document is needed to verify the compliance of the actual state of the property with the data from the registers. Without it, the conclusion of the transaction may be complicated.
Documents for Property Valuation
For tax calculation, an appraisal report is necessary. The notary will not proceed with the transaction without this document, as it is needed to determine the mandatory taxes.
Documents for Land Plot
When selling a house, it is important to confirm ownership of the land. For this, an extract from the State Land Cadastre with information about the plot is required. The absence of a cadastral number can hinder the conclusion of the transaction.
Certificate of Registered Persons
A certificate of family composition or registered persons in the property confirms the individuals who are registered in the real estate. If any of them are minors, permission from guardianship authorities is required. It is also important to have a certificate of absence of debts for utilities.
All these documents must be valid and free of errors. The notary may also require additional documents depending on the situation and type of real estate.
