Online Property Division in Ukraine: New Remote Process Launches in 2026

According to Novyny.live: Starting in 2026, Ukrainian legislation will permit the remote resolution of joint property division cases, provided all legal procedures are strictly followed. This reform aims to make the process more convenient and accessible, particularly for individuals who cannot attend court hearings in person. This change aligns with a broader global trend of digitizing legal and administrative services.

According to Article 367 of the Civil Code of Ukraine, jointly owned property can be divided in kind by mutual agreement of the parties. This allows co-owners to agree on arrangements for using specific rooms or assigning separate areas to each individual. Real estate expert Oleh Kozliak notes that

"most often, this is not about a physical division of the property, but rather about establishing rules for room usage or assigning specific premises to each co-owner."

Furthermore, under Article 364 of the Civil Code, any co-owner has the right to demand the allocation of their share. If co-owners cannot reach an agreement, the matter of dividing the joint property may be settled in court. Courts utilize a video conferencing subsystem, enabling participants to join hearings from anywhere in the world, which adds significant convenience to the proceedings.

Benefits of the New System

Additionally, a partner's share can be bought out if the other owner is formally notified in writing of the intent to sell. If no response is received within one month, the owner has the right to sell their share to a third party. This creates an opportunity for co-owners to manage their assets efficiently and avoid protracted delays.

Oleh Kozliak also points out that

"physically dividing an apartment without remodeling is only permitted in exceptional cases."
Therefore, it is important to understand that property division can be achieved not only through physical partition but also by agreeing on terms for the shared use of the asset.

Consequently, from 2026, Ukrainians will be able to resolve property division matters through online platforms, which will significantly simplify the process and make it more accessible to all parties involved.

The introduction of online methods for dividing joint property in Ukraine represents a significant step in modernizing legal processes, reducing administrative barriers, and facilitating access to justice. This reform is also likely to positively impact the real estate market by streamlining procedures for co-owners who wish to settle matters regarding their property without unnecessary delays. With these new opportunities, it is crucial for all participants to be fully aware of their rights and responsibilities under the new legal framework.
