Man sues wife for refusing to be a liver donor.
According to ТСН: In South Korea, a man has sued his wife, accusing her of 'malicious abandonment' after she refused to become a donor of part of her liver that could save his life.
Both spouses were in their 30s, married for three years, and raising two small children. Their quiet life changed last winter when the man was diagnosed with a rare disease — primary biliary cirrhosis of the liver. Doctors warned him that without a transplant, he had about a year to live.
The man received support from his parents, who financed his treatment, as well as from his wife, who stayed by his side. However, without a donor liver, his condition worsened.
When doctors learned that the wife had over 95% HLA compatibility, she could have become the perfect donor. However, the woman explained that she could not agree to the surgery due to 'pathological fear of needles and sharp objects.'
This decision sparked a storm of emotions in the man and his parents. He began ridiculing her fears, claiming that she actually wished him dead.
The situation changed when a donor was found who had been diagnosed with brain death, and the man successfully underwent a liver transplant. After that, his condition stabilized, but his wife's refusal was still a topic of discussion.
The man decided to investigate the truth of his wife's fears and learned that she had previously undergone an appendectomy without problems and had repeatedly taken blood tests. She admitted that the real reason for her refusal was fear of potential complications that could leave their children without a mother.
This explanation did not convince the man. He filed a lawsuit, accusing his wife of 'criminal abandonment' and of failing to fulfill marital duties.
The case was discussed in South Korean social media. The court sided with the woman, emphasizing that organ donation is a personal decision and cannot be considered a duty even in marriage. The court acknowledged that her refusal was justified by her concern for the children's safety.
The couple decided to divorce. Custody of the children was left with the mother, and she agreed to provide financial support to her ex-husband during his recovery after the transplant.
This case highlights the complexities of issues related to organ donation, as well as the resolution of ethical and personal conflicts in family life. Social media is actively discussing this situation, alluding to the importance of personal choices in medical decisions and responsibilities towards family.
