Ukraine's Defense Industry Gains Power to Shield Draft-Eligible Personnel Under Investigation.
Temporary Exemption for Military-Age Personnel
According to Novyny.live: Ukrainian defense industry enterprises have been granted the authority to temporarily exempt draft-eligible citizens who are under investigation from military call-ups. This new power stems from Law No. 4630‑IX, which came into force in December 2025 and governs military registration exemptions during wartime. This measure aims to balance the needs of national defense production with the legal obligations of citizens.
Under the new legislation, a temporary exemption can be granted for a period of up to 45 days. This allows defense sector companies to retain skilled personnel for critical national projects, even if those individuals have unresolved issues with their military registration. However, if the investigation is not resolved within the 45-day period, the exemption can be revoked.
Liability for Violations
It is crucial to note that the new law does not absolve draft-eligible individuals from responsibility for failing to report upon receiving a military summons. As Yevhen Korniichuk clarified:
"The law does not reduce administrative or criminal liability for violations of military registration rules."
This underscores the requirement to comply with all regulations, even under a temporary exemption.
Consequently, the new conditions for exempting draft-eligible personnel under investigation create new opportunities for defense industry enterprises but do not provide immunity from legal consequences for breaching the law.
