European Court of Human Rights Awards Compensation to Former Judge Tandyr for Extended Pre-Trial Detention.
European Court of Human Rights Ruling
According to TSN.ua: The European Court of Human Rights (ECHR) ruled on January 22nd that former judge Oleksiy Tandyr is entitled to compensation for his prolonged detention in a pre-trial detention center (SIZO) without the option of bail. This case stems from a fatal traffic accident that resulted in the death of a Ukrainian National Guardsman, Vadym Bondarenko. The ECHR's jurisdiction covers member states of the Council of Europe, including Ukraine, and its rulings are legally binding.
Oleksiy Tandyr has been in custody for over two and a half years. The ECHR found that holding him in a SIZO without proper judicial review violated Article 5 of the European Convention on Human Rights, which protects the right to liberty and security. The court ordered the state to pay Tandyr €2,100 in compensation, plus an additional €250 to cover his legal costs.
Case Background
The fatal incident occurred on May 26, 2023, when Tandyr, driving a Lexus ES350, struck and killed 22-year-old National Guardsman Vadym Bondarenko at the scene. Following the accident, Tandyr was detained and placed in the SIZO. It is notable that Tandyr was dismissed from his judicial position on August 6, 2025.
This ECHR decision underscores the critical importance of upholding human rights standards, even in cases involving serious allegations. The award of compensation to Tandyr is likely to prompt further discussion about legal procedures in Ukraine, particularly concerning extended pre-trial detention without a hearing. The case remains a sensitive issue, as it involves a tragedy that claimed the life of a serviceman and may influence public perceptions of justice in the country.
