According to TSN.ua: A Ukrainian court has sentenced a young woman to a one-year probationary term for distributing pornographic photos and videos using her mother's mobile phone. The Zboriv District Court of the Ternopil region delivered the verdict. The case details reveal that by April 2024 at the latest, the defendant had downloaded the illicit video and images onto her mother's iPhone 12 Pro Max, where they were stored in the device's memory.
Prosecutors established that from April to December 2024, she actively sent the files via the Telegram and Messenger apps. Recipients included contacts saved under the names "Ivan" and "Ihor," among several others. After reviewing the evidence, the court found her guilty under Parts 2 and 3 of Article 301 of the Criminal Code of Ukraine.
Case Circumstances and Consequences
The accused pleaded guilty in court, a factor that influenced the judges' decision. However, she is required to pay the state 8,914 hryvnias (approximately $225 USD) to cover the cost of forensic examinations. The court also considered her young age, genuine remorse, active cooperation with the investigation, and lack of a prior criminal record, which formed the basis for the probation sentence instead of imprisonment.
This case highlights the legal risks of sharing explicit digital content, even via private messaging apps. It serves as a stark reminder for young people about the serious consequences of their online actions.
