Since January 1, 2013, the State Register of Real Property Rights (SRRPR) has been operational in Ukraine. This register replaced the old accounting systems: the Register of Property Rights to Real Estate, paper books, and BTI archives. For many whose rights to real estate arose before 2013, the question of protecting their property remains relevant. To ensure full protection, this data must be entered into the SRRPR.Without registration in the SRRPR, an owner cannot fully manage their property, protect it from illegal actions, or receive compensation in case of property damage. The Ministry of Justice emphasizes that obtaining a record in the SRRPR is crucial for legal protection.
'If the ownership documents were issued in the 80s-90s without notarial forms, without stamps or marks from BTI, or without an Extract from the BTI register, such rights are not considered duly registered. This means that legally, property rights may not exist.'
Why it is important to register ownership rights in the new register
Having a record in the SRRPR guarantees the owner quick confirmation of rights, protection against illegal actions, the ability to freely dispose of property, and additional protection during wartime or in case of loss of documents.How ownership registration occurs
A property owner, whose right arose before 2013, can apply to the CNAP or a notary, or use the electronic service through the 'Diia' portal. After submitting the documents to the register, the owner will receive an extract from the SRRPR.Is re-registration mandatory
Re-registration is voluntary by law, but lawyers recommend it to be done promptly. In case there is no record in the SRRPR, you may face issues with rights to the property in case of loss of documents or complications in protecting rights during martial law. Re-registration before 2013 is carried out without paying an administrative fee.How to protect yourself from risks
