Court in Bombay ordered a woman to bring her son to his grandmother

According to ТСН: In India, the High Court of Bombay ruled that a woman must transport her 14-year-old son from Delhi to Mumbai so he can meet his 90-year-old grandmother for Christmas.

The court also established a schedule for regular visits, as the grandmother had filed a habeas corpus petition regarding the legality of the person's confinement.

The grandmother's son, Sangita Sadwani, passed away several years ago, and the relationship between her and the child's mother deteriorated. The petition stated that despite numerous requests, the grandmother had been completely deprived of the opportunity to see or communicate with her grandson, resulting in her deep emotional distress.

The grandmother's interests were represented by the law firm M/s YNA Legal LLP, led by attorneys Anvi Mehti, Dr. Suruchi Deshpande Yusuf, and Dr. Yusuf Ikbal Yusuf.

During the hearing, the child's mother noted that she currently resides in Delhi with her son.

"Given these circumstances, and also the fact that December 25 is a Christmas holiday, we order the mother to bring the minor to Mumbai and deliver him to the plaintiff's residence between 11:00 AM and 12:00 PM. The child is allowed to stay with the grandmother until 5:00 PM. Since the mother is coming from Delhi, we also expect another visit of the child to the grandmother before they return," ruled the panel of judges including Bharati Dangre and Shyam Chandak.

The High Court also established that the child must unconditionally visit the grandmother every second or fourth Sunday of the month. The mother must accompany the child or ensure his visit. In addition, she was ordered to provide an address in Delhi and contact details to the investigating officer.

The grandmother also involved the police in the case. In light of these instructions, the court decided to close the consideration of the petition, believing that the plaintiff's demands were substantially satisfied.

This case highlights the importance of family ties, especially in difficult times. The court's decision will allow the grandmother to restore communication with her grandson, which is especially important during the holidays. The situation also emphasizes the need for legal regulation of such sensitive issues in the interest of children.
