According to ТСН: From January 1, 2026, due to the change in the minimum subsistence level for able-bodied individuals, new court fee rates will be introduced — up to 3328 UAH (instead of 3028 UAH).

This information was announced by the Eastern Commercial Court of Appeal.

Changes in court fee payment

According to Article 4 of the Law of Ukraine on Court Fees, the court fee is paid in the appropriate amount based on the minimum subsistence level for able-bodied individuals, which is determined on January 1 of each year when a claim or complaint is submitted to the court. The fee amount depends on the value of the claim and can be fixed.

These innovations will affect the payment of claims both of a property and non-property nature, as well as in bankruptcy cases, appeals of court decisions, and other procedural documents.

Exemptions from court fee payment

In addition, the list of categories of citizens exempt from court fee payment has been updated. These include military personnel, participants in combat operations, persons with disabilities, and citizens affected by the armed aggression of the Russian Federation. From July 16, 2025, the criteria for deferral, installment, reduction, or exemption from fee payment will be expanded.

It should be noted that next year social standards will change, which will automatically lead to an increase in tax payments for all groups of entrepreneurs.

These legislative changes reflect the current socio-economic realities in Ukraine and emphasize support for certain categories of the population. The increase in court fees may affect the accessibility of justice, especially for those with limited financial capabilities. The need for a balanced approach to these changes is becoming increasingly obvious, as the new rates and criteria may pose a serious challenge for many Ukrainians.
