Inheritance with Debts: How to Check the Obligations of the Deceased and Avoid Problems.
According to ТСН: Inheritance is not only rights but also obligations that the deceased had at the time of inheritance opening, which did not disappear due to their death.
Therefore, heirs can receive not only real estate but also the debts of the deceased, the press service of the Ministry of Justice reports.
Such debts may include unpaid loans, utility payments, alimony, and other financial obligations.
According to Ukrainian legislation, heirs who have accepted the inheritance are obliged to notify the creditor about the opening of the inheritance and to pay off the debts.
According to Article 1281 of the Civil Code, heirs must notify the creditor of the deceased about the opening of the inheritance if they know about their debts or if they inherit property encumbered with the rights of third parties.
In addition, in case of a prohibition on disposal or encumbrance of real estate with a mortgage, the notary provides a certificate of the right to inheritance and informs the creditor in writing within two working days.
How to Check if the Deceased is a Debtor
On the website of the Judicial Authority of Ukraine, you can check if the deceased is a participant in court proceedings by entering their last name, first name, and patronymic.
Check for the presence of enforcement proceedings against the deceased.
Ensure whether the deceased is in the Unified Register of Debtors.
