Deferral for parents of children with disabilities blocked in Reserve+: what to do.
According to ТСН: A father of a child with a disability has the right to deferment from mobilization, but, as it turned out, received an unexpected denial. Social services confirmed all necessary data, but the Reserve+ system was unable to upload information about the child's disability, which is why the request was not satisfied.
Lawyer Andriy Karpenko noted that technical failures in the system occur, but they can be resolved.
Why did the problem arise?
The man explained that last autumn social protection confirmed the presence of data in the Central Disability Register. However, at the beginning of November, the Reserve+ system reported that it could not find information about the child's status.
The father believes that the problem could be a duplicate birth certificate, as the original is with the child's mother abroad.
The lawyer clarifies that duplicates are usually not an obstacle, but problems can occur when entering data if a technical or arithmetic error occurred that prevents the system from recognizing the child or their status.
What to do in this situation?
The lawyer advises to take the following actions:
update the Reserve+ application and repeat the request;
verify the information in the electronic cabinet of the person with a disability;
in case of discrepancies, contact social protection authorities for data correction;
check the validity period of the disability document — if the period has expired, the system blocks the processing of deferment until medical information is updated.
If necessary, social protection or CNAP employees should manually check all documents: the series and number of the certificate, medical references, terms of reassessment, and the validity of disability. Most often, the reason for denial is a simple technical error.
Where to apply if the deferment was not confirmed?
If the electronic system refuses, the lawyer suggests submitting a full package of documents in paper form to the CNAP. The decision based on paper documents has legal force, even when electronic registers fail.
To submit an application, the following documents are required:
birth certificate or ID card of the child;
child's RONKPP (if any);
RONKPP of one of the parents;
pension certificate (if available);
medical conclusion or MSEC certificate (depending on age);
for adult children — form No. 157-1/o;
extract about the place of residence.
What will change after December 1?
From the beginning of December, some servicemen may lose the right to deferment if the grounds for granting it have disappeared or the validity period of the documents has expired.
Persons with disabilities will only be mobilized on a voluntary basis, provided there are no significant medical restrictions.
Also, from December 4, new rules for reserving employees of critically important enterprises will be introduced: men with military registration problems can be reserved for only 45 days.
Thus, it is important for parents of children with disabilities and servicemen to know their rights and potential actions in case of unforeseen situations. Technical failures in the system can become an obstacle, but they should be quickly resolved through the right steps. With the upcoming new rules, it is important to stay informed about changes in order to respond in a timely manner and not lose the right to deferment.
