Court gives 15 years to HIV-positive rapist: child was not infected.
According to ТСН: In the Dnipropetrovsk region, a 39-year-old man was sentenced to 15 years in prison for committing sexual violence against a minor girl. The perpetrator was aware of his HIV-positive status and knowingly put the child at risk.
Circumstances of the crime
The incident occurred in 2023 when the convict entered the house where his acquaintance had previously lived, not suspecting that another family now resided there. At that time, the children's mother was at work.
The man illegally broke into the dwelling, grabbed the girl, and dragged her into a room. The younger brother managed to escape outside and hide, which probably saved his life. Neighbors, hearing the screams, called the police, who detained the attacker at the crime scene.
Intentional infection and the child's condition
The investigation established that at the time of the crime, the man knew about his HIV-positive status. Despite this, he committed violence, putting the girl's life in danger.
According to medical examination results, fortunately, the girl's infection was not confirmed.
Court ruling
The court made a ruling supporting the position of the regional prosecutor's office and found the defendant guilty under three articles of the Criminal Code of Ukraine:
Part 4 of Art. 152 (sexual violence against a minor);
Part 1 of Art. 130 (intentional endangerment of another person's infection with HIV);
Part 1 of Art. 162 (illegal entry into a dwelling).
The offender was sentenced to 15 years in prison, which is the maximum term for these crimes. Information about the convict will be recorded in the Unified Register of Persons Convicted of Crimes Against Sexual Freedom and Integrity of Minors.
It was also reported about the detention in Kyiv of a well-known athlete, a jiu-jitsu coach on suspicion of sexual violence against an 11-year-old girl.
This case has caused a wide public outcry, as it touches upon the issues of child safety and adult responsibility. It emphasizes the importance of supporting victims of violence and harsher punishment for offenders to prevent similar incidents in the future.
